Lawsuit Filed in Hit-and-Run Driver in Wrongful Death incident

JT Legal Group, a personal injury law firm, represents the wife and daughter of a truck driver, Samson Ayrapetyan, who was killed in a trucking accident on On August 25, 2020, in Miami, FL,. The driver is believed to be Dwayne Holmes who was driving an 18-wheel truck for CRST International, one of the nation’s largest trucking companies, with revenues exceeding 1.5 billion per year. 

Mr. Ayrapetyan worked as a cross-country truck driver. He was unloading cargo from his tractor trailer when he was struck from the rear. 

According to witnesses, just prior to the accident, Mr. Ayrapetyan’s truck was parked on the street. He was walking towards the front of his car when Mr. Holmes’s truck careened to the right, hitting Mr. Ayrapetyan’s truck. Upon impact, Mr. Ayrapetyan turned around, he saw the truck heading towards him, and he tried to run away. Unfortunately, the truck was going too fast, Mr. Ayrapetyan was pulled underneath its wheels. Mr. Ayrapetyan was dragged several feet and run over several times between multiple sets of tires. Bystanders who came to aid in the accident heard Mr. Ayrapetyan’s screams for help, but found him dismembered more than 20ft away from where the accident took place.

Witnesses say following the accident, the defendant sped off. The defendant’s truck was found more than 150 miles away from the accident. Three days after the incident, the defendant surrendered himself to the police.

One witness stated that even though her windows were up and her music was loud, she could hear Mr. Ayrapetyan screaming in pain. Mr. Ayrapetyan passed away on the scene, before ambulances could arrive. 

Although he was not immediately charged, JT Legal Group has confirmed the defendant, Dwayne Holmes, has a lengthy arrest history involving public intoxication, drug possession, disorderly conduct, resisting arrest, and other motor vehicle infractions. CRST, the trucking company who employs the defendant, has a total of 13 fatalities, injured 113 individuals in crashes, has been towed 256 times with a total of 382 accidents over the course of 24 months.

More than a year later, the Ayrapetyan family has yet to receive answers regarding the collision and police report from the Miami Police Department, the autopsy containing irrefutable facts on the cause of death, and the criminal proceedings of the defendant.
