JT Legal Group Secures $300,000
28 March 2022: JT Legal Group, a law corporation specializing in personal injury successfully secured $300,000 from a pedestrian accident.
Our client was on California St. crossing Seville in Walnut Park, CA. She was traveling in an electric wheelchair going towards her house. The defendant was in her vehicle traveling down California Street and failed to yield the right of way for our client. The defendant immediately made an unsafe left turn, striking our client with such force it caused her to fall off of her wheelchair.
The defendant approached our client, attempted to pull her off the ground and yelled, “ Stand up, stand up, there is nothing wrong with you!” When clearly our client was on a wheelchair because she suffers from spina bifida and cerebral palsy.
Our client had a pre-existing condition called Spina Bifida which affects the growth of the spine and is usually apparent at birth. Cerebral palsy is a group of disorders that affect a person’s ability to move and maintain balance and posture. The defense argued that her injuries from the accident were from her pre-existing disability and only offered $23,000 to compensate for what they believed was fair.
According to the National Highway Traffic Safety Administration, in 2018 there were an estimated 75,000 pedestrians injured, which is a 5.4% increase from 2017. In the United States, over 3,100 people were killed and about 424,000 were injured in crashes involving a distracted driver in 2019. About 1 in 5 of the people who died in crashes involving a distracted driver in 2019 were not in vehicles; they were walking, riding their bikes, or otherwise outside a vehicle.
