3 People Dead, 18 Hospitalized After Bus Rolls Off California Highway

At least three people died in a bus accident near Fallbrook, California on Saturday, 22nd February. The charter bus toppled over a highway embankment, injuring at least 18 and killing three. The accident occurred approximately around 10:35 AM local time on the Interstate 15 near Fallbrook, Calif., as reported by NBC News. The accident occurred about 60 miles north of San Diego

Charter buses in the area are often used to transport people to the numerous Native American casinos in the greater San Diego area. The accident tragically happened less than five miles from Pala Casino Spa and Resort in Pala, Calif. The bus was reportedly travelling from El Monte in East Los Angeles County to San Ysidro, according to California Highway Patrol. The bus reportedly had seatbelts but the passengers did not use them. Further investigation is pending as the cause of the crash is still unknown. The bus reportedly skidded on the dirt and overturned, landing on its roof after rolling over several times. First responders took about 45 minutes to extricate all passengers from the upside-down bus. Several of the passengers were able to crawl out but at least one passenger was still trapped inside. One victim was found dead inside the bus.

The bus driver, a fifty-two-year-old man from Whittier, California, survived with minor injuries. The eighteen victims were taken to Inland Valley Hospital, Palomar Medical Center, and Temecula for injuries ranging from minor to critical condition. Several of the eighteen passengers are in critical condition, including a five-year-old boy. A Sig Alert was issued for the area after the lanes of traffic on the Interstate 15 were closed so that first responders had access to the site of the accident. First responder crews from Camp Pendleton, Pala Mesa, CalFire, Oceanside and Vista were assisting, according to NCFPD Capt. John Choi.

Accidents such as these are tragic and no amount of monetary compensation can help bring back those who have lost their lives in the accident. However, insurance companies often take advantage of the shock and trauma that victims suffer to deny their claims if they have been delayed.

Further, in cases such as these, it is likely that insurance companies would try to interrogate the victims further to assuage their liability in this horrific accident, such as the fact that they were not wearing seatbelts. Many factors need to be considered when determining the liability in a case of a car accident. Often, the negligence of the driver comes into play or in some cases, improper maintenance of roads and highway infrastructure could factor in.

However, in cases such as these, it is important to call a personal injury lawyer immediately to ensure that you have adequate representation and a thorough investigation has been done. In such a case, it is likely that the transit company behind the charter bus would employ a large team of litigators to protect the driver and their own company from paying any compensatory costs.

In such cases, there are often two kinds of personal injuries that victims have to look out for: soft tissue injuries and hard injuries. Soft tissue injuries include minor injuries such as bruising, abrasions and sprains. These require a relatively low level of medical treatment and therapy. However, hard injuries, as can be seen in this case with the various patients in critical condition, are far more serious. These include head trauma, fractures, loss of limbs, and other serious injuries.

Treatment for the same ends up being expensive and without reliable insurance coverage, tragic accidents such as these can put a victim into a lifetime of debt for no fault of their own. In hard injury cases, it is common for insurance companies or transit companies to offer an amount which the victim believes to be fair. However, the average person is unaware of the amount they are entitled to in such cases and claims adjusters will only seek to take advantage of the same.
